Candidacy Annulment: Omo-Agege Panics, Runs to Seek Court Leave to Appeal Judgement

The embattled All Progressives Congress, APC, Delta Central Senator, Barr Ovie Omo-Agege whose candidacy and amongst others, was annulled by the judgement of  Federal High Court 1, Asaba, Delta State, has dashed to seek the leave of the court to appeal the judgment as an impacted party.

Recall that the Federal High Court 1, Asaba, in its March 18, 2019, judgement delivered by Justice Toyin Adegoke sacked the Prophet Jones Erue-led factional State Executive Committee, upholding the Chief Cyril Ogodo faction as the authentic party’s State Executive Committee.

The court went further in its judgement to annul all actions taken by the sacked Jones Erue-led Exco, including party primaries and the list of candidates which emerged from their factional primaries declaring it null and void.

Meanwhile, Senator Omo-Agege through his Senior Special Adviser Communications & Strategy, Mr Godwin Anaughe in an earlier statement had declared that the Federal High Court judgement has, “no moment and does not and cannot alter the status quo.”

He maintained that Senator Ovie Omo-Agege remains the Senator-Elect because the Electoral College that elected Senator Omo-Agege as APC candidates in the just concluded 2019 general elections came into being by virtue of a consent judgement that has not been set aside.

However, Senator Omo-Agege who in the past few days has claimed that he will not be affected by the judgement because he was not made a party to the case, in a new twist, has now rushed to court to seek the leave of the court to appeal the judgement annulling his candidacy, thereby factually acknowledging the annulment of his candidacy.

Also in court to seek leave of court to the appeal, is Rev Francis Waive who was declared winner of the Delta Ughelli North, South and Udu Federal House of Representative seat.

Omo-Agege and Waive had through their counsel Barr. Alex Izeyon, SAN, while seeking the leave of the court to appeal the judgement, in their desperation, filed an exparte motion which was granted to them to enable them serve Chief Cyril Ogodo by pasting service at the state party secretariat in Asaba as Ogodo is now the legally recognized Delta APC state Chairman.

By this move, the counsel to Omo-Agege has by implication accepted and acknowledged Chief Ogodo led state exco, an action which has sent panic into the Ogboru/Omo-Agege/Erue camp, as their supporters are becoming apprehensive of their fate should the appeal fail.
